MotionMate sales terms
These sales terms govern the sale of video editing services made through MotionMate between a creator (client) and an editor (provider). MotionMate acts as a trusted intermediary and is not a party to the sale contract.
⚠ Draft document, currently under legal review. A final version validated by a law firm will be published before going to production. Contact: contact@motionmate.fr.
1. Scope
These sales terms apply to every order placed through MotionMate, whether buying gig packs (Basic/Standard/Premium) or paying custom jobs. They complement the Terms of Service.
2. Pricing
Prices are displayed in euros incl. VAT, stored in cents and rounded for display. For VAT-registered editors, the applicable VAT is shown on the invoice issued after delivery is approved.
3. MotionMate commission
MotionMate takes a 10% (excl. VAT) commission on each successful transaction. It is owed by the editor and deducted automatically via Stripe Connect (`application_fee_amount`). No hidden fee applies on the creator side.
4. Escrow
The payment is captured by Stripe immediately upon order. Funds are held in escrow until the creator approves the delivery. Once approved, the net amount (90%) is transferred to the editor within 1 to 7 business days depending on their Stripe Payouts settings.
5. Delivery
The delivery deadline shown in the pack or agreed at brief is a commitment from the editor. The editor submits the delivery through the platform. The creator has 7 days to approve or request revisions, in line with the purchased pack.
6. Refund
As long as the delivery has not been approved, the creator may request a full refund through the platform. Once approved, refunds are no longer automatic and must be requested from support with a justified ground.
7. Right of withdrawal
Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to services fully performed with the consumer's agreement (delivery approval). Before approval, the order can be cancelled at no cost.
8. Disputes
In case of dispute, MotionMate support steps in for mediation. If a chargeback is opened via Stripe, the order automatically moves to 'disputed' and funds are frozen until resolution. For EU consumers, recourse to the competent consumer mediator remains available.
